Avinis GmbH, headquartered at Friedmattstrasse 31, 8906 Bonstetten, Switzerland, registered in the Commercial Register of the Canton of Zurich under number CHE-105.622.273, is the operator of the website www.avinis.com and publisher of the VinoMobile apps about wine for the iOS and Android operating systems.

 

As such, we are responsible for the collection, processing and use of your personal data and for handling such data in accordance with the law.

 

We take privacy seriously and are committed to protecting your personal information. In the following, we would like to inform you about how we process your personal data in connection with our website and the VinoMobile applications.

 

Please note that the following information will be reviewed and changed from time to time. We therefore encourage you to review this Privacy Policy on a regular basis.
 


1. Visit to our Website
 

1.1 Scope and purpose of the collection, processing and use of personal data
 

We use our website to present our company and our products. You can contact us there by email using the contact form. We do not collect any other personal data.


We operate the website with the modular system of WIX.com Ltd (www.wix.com), whose privacy policy you can view here.


This order processor stores every access to our website in a log file. This is usually non-identifiable personal data such as device, operating system, internet browser, screen resolution, language and keyboard settings, internet service provider, referring and exit pages, date/time stamp, etc.

 

§ This data is collected and processed to enable the use of our website ("connection setup") and to ensure system security and stability on a permanent basis, as well as for internal statistical purposes. Our legitimate interest in data processing within the meaning of Art. 6 (1) lit. f DSGVO lies in the purposes described above.

1.2 Cookies
 

When you visit our website, our service provider WIX.com collects information using cookies. As cookies are not relevant for our website, we would like to disable them in general, but this is not technically possible.
 

Cookies are information files that your web browser automatically stores on your device's hard drive when you visit websites. They do not damage your device and do not transmit any personal user data to us.

 

Among many other things, cookies help make your visit to websites easier. For example, they are essential for websites that have a shop or that require you to log in.

2. Download and Use of VinoMobile Apps
 

We have developed several smartphone and tablet wine apps that we sell/distribute through the Apple Store and Google Play. By downloading these apps from either store, you agree to the terms and conditions and privacy policy applicable to that store.

We rely on usage data and crash reports to help us develop these apps. Therefore, we connect our apps to Firebase, Google's development platform, and analyze this data with Google Analytics for Mobile Apps.

2.1 Scope and purpose of the collection, processing and use of personal data
 

In the following, we show for each VinoMobile app whether and which data is currently collected when using the app.

2.1.1 Wine Vintages, Wine Profiles, Wine Trainer, Wine Temperatures
 

We do not collect any personal data.
We analyze the usage and performance of these apps with Google Analytics for mobile apps. We also use the Google Firebase/inApp messaging service to sporadically send notifications to our anonymous users. See also 2.1.2 b)

2.1.2 Wine Tasting
 

a) Personal data

 

Several core features of the app, such as FriendsTasting, the backup feature for tasting notes, or access from different devices, require a minimal online user profile. This is managed through the Firebase authentication service and consists of:

 

  • Email address

  • Password (encrypted by Firebase, not visible to us).
     

We also store user profile settings (pseudonym, scoring system, and access level) as well as tasting notes in the  Firebase database. No device IDs are recorded.

By creating a user profile in the app, you confirm that you have taken note of our privacy policy.
You can delete your account at any time from the app or have us delete it for you. (see section 5 "Contact").

Please note that wine data (i.e., wine name, vintage, producer, region, and label) that you have entered as the host of a tasting cannot be deleted if this data is linked to tasting notes of other participants.


If you delete your account, most of the features of the PRO version can no longer be used (see Basic/Pro level comparison in the app). Any refund is subject to the terms and conditions of the vendor from which the app was purchased (Apple or Google, respectively).

§ The collection and processing of this data serves the purpose of enabling the use of this app. This is our legitimate interest in data processing within the meaning of Art. 6 (1) lit. f DSGVO.

b) Anonymous data tracking and notifications

 

We analyze the usage and performance of the app and evaluate errors and crashes. We also use the so-called in-app notifications to send news and messages to users.

For usage and performance analysis, we use Google Analytics for Mobile Apps, which allows us to analyze anonymized information, such as
 

  • Number of users, their characteristics and where they come from

  • Actions performed in the app

  • In-app payments

  • Navigation paths of users.


We use Firebase Crashlytics for error and crash analysis and Firebase In-App Messaging for notifications. Both services are provided by Google.

Google is legally bound by various legal requirements, in particular to ensure an adequate level of data protection.

 

§ This data is collected and processed to ensure stability, to enable optimization of the app, to send messages via the app, and for internal statistical purposes. Our legitimate interest in data processing within the meaning of Art. 6 (1) lit. f DSGVO lies in the purposes described above.

3. Disclosure of Data to Third Parties
 

We consider the personal data mentioned in this privacy policy to be confidential and will treat it accordingly.
 

We will not share this information with third parties unless required to comply with laws, court orders or legal process, to enforce or apply our agreements, or to protect us or our rights, or if you have given your express consent to do so.

 


4. Data Security
 

Your information is managed by two global service providers (WIX and GOOGLE) that have implemented extensive technical and organizational security measures to protect personal information from loss, misuse or alteration. However, it is not possible to guarantee the absolute security of personal information. You should also be aware that data transmitted over an open network, such as the Internet or an email service, is openly accessible.

 

We cannot guarantee the confidentiality of any messages or content exchanged over these networks. If you disclose personal information over an open network, you should be aware that third parties may be able to access, collect and use that information for their own purposes.
